Admission requirements<\/b>
As a candidate for the patent attorney training, you must evidence your technical competence. This requirement is satisfied by a degree in a science or technical subject conferred on the basis of a government-administered or academic examination at an academic institution. A university of applied sciences does not qualify as an academic institution within the meaning of the Patent Attorneys’ Regulations. Additionally, you should ideally have completed at least one year of work in a technical field. This requirement may already be satisfied by industrial internships you may have completed alongside your academic curriculum.
In addition, the training requires a request for admission letter to be sent to the President of the German Patent and Trademark Office.<\/p>\n
Start and duration<\/b>
Your training starts on the day your instructor – our law firm – officially registers you as a patent attorney candidate. The training extends over a period of 26 months from the date we have registered you as a patent attorney candidate and is the same length at all candidate-hosting law firms. If you want to move seamlessly into the subsequent office year, the start of your training should be chosen accordingly. Due to the start dates offered by the German Patent and Trademark Office \/ Federal Patent Court for the office year, the notification date should be selected as either April 1, August 1, or December 1.<\/p>\n

The training at the law firm should, in addition to imparting legal know-how, above all serve the acquisition of practical experience in the application of said legal know-how. This is because the job of a patent attorney is ultimately about successfully applying the previously gained theoretical knowledge. It is therefore important to us that you have ample opportunity to familiarize yourself with the tasks that will later characterize your professional life. Another part of the training is participation in a monthly working group. You will receive the invitations together with your training admission notice. The working groups will develop the essential knowledge about industrial property rights and protection. These working groups usually consist of lectures delivered by patent attorney candidates on a particular topic, as well as Q&A sessions on the relevant topics. In addition to the training at the law firm, you will also complete two years of general legal training at a university. Currently, the course “Law for Patent Attorneys” offered by the Hagen Distance Learning University is the only recognized course. The study requirement can only be waived if you have already sat and passed the first state examination in law.
In contrast to other law firms, Westphal, Mussgnug & Partner will cover your study costs as well as your costs incurred in connection with the attendance phases in Hagen and the graduation in Munich.<\/p>\n

The President of the Patent Court will compile the plan for your training at the Patent Court. Admission to the office year requires completion of the distance learning course “Law for Patent Attorneys”. An application for training must be submitted to the Patent Office and Patent Court three months before your training at the law firm comes to an end.
We are happy to offer you the opportunity to continue working for our firm throughout the full office year, last but not least to continue receiving an income. This only requires the aforementioned application to include a request for permission of secondary employment, which in most cases is granted by the President of the German Patent and Trademark Office.<\/p>\n

The training at the German Patent and Trademark Office lasts 2 months. The German Patent and Trademark Office and the Federal Patent Court currently only offer the following intake dates for the office year: February 1, June 1 and October 1<\/p>\n
Content<\/b>
At the German Patent and Trademark Office, you will be assigned tasks that are part of the daily work of examiners, namely patent and trademark examiners. Depending on the examiner, these tasks can be worked on in the office or from home. While your work on these tasks is ongoing, you can already sit in at various oral hearings. The German Patent and Trademark Office holds mandatory working groups, which take place in the form of training courses. There are also some exams, but their results are not included when the final mark from the written and oral examinations is calculated.<\/p>\n

A request for admission will have to be sent to the President of the German Patent and Trademark Office before you can start step 4. The request must be submitted no later than 2 months before the first day of the month in which you have requested your examination to take place. The subsequently issued admission notice will set out the dates for the written examinations. Westphal, Mussgnug & Partner will pay the examination fee under the condition that you commit to continue your employment with our law firm after completion of your training. Voraussetzungen<\/b>
Als Patentanwaltsbewerber m\u00fcssen Sie eine technische Bef\u00e4higung nachweisen. Diese gilt dann als erworben, wenn Sie nach dem Studium naturwissenschaftlicher oder technischer F\u00e4cher eine staatliche oder akademische Pr\u00fcfung an einer wissenschaftlichen Hochschule mit Erfolg abgeschlossen haben. Eine Fachhochschule ist keine wissenschaftliche Hochschule im Sinne der Patentanwaltsordnung. Au\u00dferdem sollten Sie nach M\u00f6glichkeit ein Jahr praktische technische T\u00e4tigkeit abgeleistet haben. Diese Bedingung kann aber unter Umst\u00e4nden durch die bereits w\u00e4hrend des Studiums durchgef\u00fchrten Industriepraktika erf\u00fcllt sein.
F\u00fcr die Ausbildung muss dar\u00fcber hinaus ein Zulassungsgesuch an den Pr\u00e4sidenten des Deutschen Patent- und Markenamts gerichtet werden.<\/p>
Beginn und Dauer<\/b>
Ihre Ausbildung beginnt an dem Tag, an dem wir, als Ihr Ausbilder, Sie offiziell als Patentanwaltsbewerber melden. Die Ausbildung dauert bei uns, wie bei jedem anderen Patentanwalt, 26 Monate, nachdem Sie als Patentanwaltsbewerber gemeldet worden sind. Wenn Sie nahtlos in das darauffolgende Amtsjahr \u00fcbergehen m\u00f6chten, sollte der Beginn Ihrer Ausbildung dementsprechend gew\u00e4hlt werden. Aufgrund der angebotenen Starttermine des Amtsjahres seitens des DPMA\/BPatG sollten als Meldezeitpunkte in diesem Fall der 1.04., der 1.08. oder der der 1.12. gew\u00e4hlt werden.<\/p>
Inhalt<\/b>
Die Ausbildung beim Patentanwalt soll neben dem Erwerb von Rechtskenntnissen vor allem dem Erwerb praktischer Erfahrungen bei deren Anwendung dieser dienen. Denn beim Beruf des Patentanwalts kommt es letztlich darauf an, dass die theoretischen Kenntnisse auch erfolgreich eingesetzt werden. Uns ist es deswegen wichtig, dass Sie von Anfang an Einblicke in die T\u00e4tigkeiten bekommen, die sp\u00e4ter Ihr Berufsleben bestimmen werden. Ein weiterer Teil der Ausbildung ist die monatliche Teilnahme an einer Arbeitsgemeinschaft. Die Einladungen dazu erhalten Sie mit Ihrer Zulassung zur Ausbildung. Hier erwerben Sie wesentliche Kenntnisse aus dem Bereich des gewerblichen Rechtsschutzes. Diese Arbeitsgemeinschaften bestehen in der Regel aus Vortr\u00e4gen, die die Patentanwaltsbewerber zu einem bestimmten Thema halten, sowie Fragen und Antworten zu den entsprechenden Themen. Neben der Ausbildung beim Patentanwalt absolvieren Sie zwei Jahre lang eine Ausbildung im allgemeinen Recht an einer Universit\u00e4t. Anerkannt wird bislang nur der von der Fernuniversit\u00e4t Hagen angebotene Studiengang \u201cRecht f\u00fcr Patentanw\u00e4lte\u201d. Umgangen werden kann dieser Studiengang lediglich dann, wenn Sie bereits das erste juristische Staatsexamen haben.

Der Ausbildungsabschnitt beim Patentgericht schlie\u00dft sich unmittelbar an die Ausbildung beim Deutschen Patent- und Markenamt an und dauert sechs Monate.<\/p>
Inhalt<\/b>
Der Pr\u00e4sident des Patentgerichts erstellt den Plan f\u00fcr die Ausbildung beim Patentgericht. In der Regel sind Sie verpflichtet, an einer bestimmten Anzahl von m\u00fcndlichen Verhandlungen der Nichtigkeitssenate, des Gebrauchsmuster-Beschwerdesenates und des Juristischen Beschwerdesenates teilzunehmen. Auch Arbeitsgemeinschaften, die von einem Klausurenkurs begleitet werden, finden weiterhin statt.<\/p>

Voraussetzungen<\/b>
Um am Amtsjahr teilnehmen zu k\u00f6nnen, m\u00fcssen Sie das Fernstudium \"Recht f\u00fcr Patentanw\u00e4lte\u201d abgeschlossen haben. Drei Monate vor Abschluss Ihrer Ausbildung zum Patentanwalt m\u00fcssen Sie daf\u00fcr einen entsprechenden Antrag auf Ausbildung beim Patentamt und beim Patentgericht stellen.
Wir bieten Ihnen gerne an, w\u00e4hrend des gesamten Amtsjahres weiterhin f\u00fcr uns t\u00e4tig zu sein, nicht nur, um auch in diesem Jahr Einkommen zu erzielen. Dazu muss mit dem oben genannten Antrag lediglich eine Genehmigung auf eine Nebent\u00e4tigkeit eingeholt werden, die vom Pr\u00e4sidenten des Deutschen Patent- und Markenamtes erteilt wird.<\/p>
Beginn und Dauer<\/b>
Die Ausbildung beim Deutschen Patent- und Markenamt dauert 2 Monate. Im Moment werden seitens des Deutschen Patent- und Markenamtes bzw. des Bundespatentgerichts ausschlie\u00dflich die folgenden Termine zum Start des Amtsjahres angeboten: der 1.02., der 1.06. sowie der 1.10.<\/p>
Inhalt<\/b>
Beim Deutschen Patent- und Markenamt werden Sie mit Aufgaben betraut, die normalerweise von Pr\u00fcfern, n\u00e4mlich Patent- und Markenpr\u00fcfern, wahrgenommen werden. Diese k\u00f6nnen, je nach Pr\u00fcfer, vor Ort oder auch von zu Hause aus erledigt werden. Dar\u00fcber hinaus k\u00f6nnen Sie bereits jetzt an unterschiedlichen m\u00fcndlichen Verhandlungen teilnehmen. Beim Deutschen Patent- und Markenamt werden verpflichtende Arbeitsgemeinschaften, die in Form von Lehrg\u00e4ngen stattfinden, abgehalten. Innerhalb dieser werden auch Klausuren geschrieben, die aber nicht in Ihre Endnote aus dem schriftlichen oder m\u00fcndlichen Examen einflie\u00dfen.<\/p>

Wenn Sie das Ziel der Ausbildung beim Patentgericht erreicht haben, kommt Step 4 und das Ende Ihrer Ausbildung naht. Vorab muss ein Antrag auf Zulassung zur Pr\u00fcfung beim Pr\u00e4sidenten des Deutschen Patent- und Markenamtes gestellt werden. Dieser muss sp\u00e4testens 2 Monate vor dem Monatsersten des beantragten Pr\u00fcfungstermins gestellt werden. In dem daraufhin erteilten Zulassungsbescheid werden Ihnen die Termine f\u00fcr die schriftlichen Pr\u00fcfungen mitgeteilt.
